Más allá del castigo: exploraciones hacia una justicia restaurativa autogestionada en casos de violencia sexual

Resumen
Este artículo explora las posibilidades de justicia para personas que han vivido violencia sexual, en donde el sistema penal resulta en gran medida inaccesible, ineficaz y revictimizante. A partir de una metodología cualitativa que combina autoetnografía y entrevistas semiabiertas, se articula la propia experiencia con las reflexiones de cinco personas de distintas identidades de género que han atravesado violencia sexual. Desde una perspectiva feminista interseccional, crítica del punitivismo e inspirada en aportes decoloniales, se analizan los límites de las respuestas retributivas y se recuperan prácticas no institucionalizadas de búsqueda de reparación, reconocimiento y transformación al margen del sistema judicial. El análisis permite identificar dimensiones clave para pensar una justicia restaurativa autogestionada y situada: centralizando el deseo, la agencia, el cuidado, la participación comunitaria y una política de la memoria que desplace el foco del castigo hacia la reconstrucción de vínculos y sentidos. Más que formular un modelo cerrado, el texto propone un mapa en construcción de principios y prácticas que pueden orientar procesos de justicia transformadora en contextos de violencia estructural e instituciones necropolíticas.
