The process of adjudication as collective action

Abstract

One way to analyze the process of adjudication the Law is to understand it as a collective action. In this work the author exposes, first, five conceptions of collective action (Bratman, Shapiro, Kutz, Gilbert and Sánchez-Brígido); Second, he criticizes these conceptions for not having made important distinctions between levels of analysis and focus, which has affected their treatment of the Law’s normativity. Finally, the author ends by exposing his conventionalist vision of law, which overcomes the difficulties of the conceptions examined.
