Contractual Detachment and the Intrinsic Value of the Contract

Abstract

This paper aims to formulate critical considerations to Dori Kimel’s detachment thesis. Three critical observations are put forward that offer difficulties so that the personal detachment between the contracting parties constitutes the intrinsic value of the contract. Finally, the com­mitment of this proposal with the presence of a uniform normative foundation in contract law is critically evaluated.
