Contribution to the study of precautionary measures prior to the lawsuit in the Chilean civil process

Abstract

This paper reflects on the regime of precautionary measures when these are requested prior to the start of the process. In this sense, it is used to analyze the conditions under which it may be granted and maintained an injunction under such circumstances as the reasons why those conditions are more stringent than those applicable to the measures required under the general scheme. Finally it demonstrates that this more stringent regime is compatible with the fundamental right to interim protection.
