Gender perspective as hermeneutics in judicial review by the chilean Constitutional Court

Abstract
In recent years, the Constitutional Court of Chile has shifted from an initially restrictive interpretation of gender equality to a more comprehensive approach that incorporates international women’s rights standards. This article analyses the extent to which the Constitutional Court has integrated a gender perspective in its rulings on judicial review and highlights the most significant jurisprudential milestones that reflect this. Additionally, this text presents the concepts of constitutional hermeneutics with a gender perspective and feminist constitutionalism. Constitutional hermeneutics with a gender perspective represents a significant critique and expansion of the traditional interpretive paradigm in the field of constitutional law. Feminist constitutionalism aims to unveil the patriarchal structures embedded in constitutional texts and practices and proposes alternative forms of interpretation and application of the law that promote substantive equality and gender justice.
