The provider’s duty of professionalism: content and objective parameters

Abstract

This work intends to be a contribution in clarifying the content of the provider’s duty of pro­fessionalism and the objetive parameters that define it in the context of consumer law. The paper states that it is the standard of diligence expected from the provider, the breach of which constitutes negligence when it is required to assign liability. In turn, the objective parameters that define this duty, and that can be considered to determine the amount of the fine, are the provider’s habitual trade and expertise.
