Legal expansionism on Mapuche land. Arauco's Province creation and its criminal-penal efects

Abstract
The study approaches an aspect of the relation of the Chilean State with the Mapuche people, as he is the one of the legal entail. It is the question of configuration of a forged legal institutionality from the center of the Republic and that one projected on the territory and population Mapuche that we denominated as legal expansionism. The nineteenth-century legal norm, that marked the beginning of this process, is that one created the province of Arauco.
The Chelean advance on Mapuche's land that legitimized this law is examined here through its penal reality. In I make concrete there is studied him juridical-penal established order and the criminal reality that is possible to visualize in the last decades of the 19th century in this border space.
