Criminal mediation as a rhetorical-discursive practice

Abstract
Criminal mediation is an Alternative Dispute Resolution (ADR) mechanism whose legal relevance is closely tied to its theoretical and methodological limitations regarding the conception and use of language in its implementation. This article offers a reflection on the centrality of language in criminal mediation and highlight the pressing need within the legal field to recognize it as a rhetorical-discursive practice, given the ontological possibilities this opens for citizenship. In the first part of the paper, we examine some of the inherent limitations of the traditional treatment of criminal mediation in the legal field, which result in a diminished potential of this ADR pathway. In the second part, we present some of the theoretical principles of the rhetorical approach in social psychology and, thereby, the potential -not only legal, but primarily social and cultural- that comes with considering -and strengthening- criminal mediation as a rhetorical-discursive practice. Ultimately, framing criminal mediation as a rhetorical-discursive practice within the juridical domain may represent a pivotal step toward constructing argumentative societies and developing non-violent relational frameworks for navigating conflict in everyday life.
