Description and analysis of the Law on School Violence (N° 20.536): two antagonistic paradigms

Abstract

This paper has as purpose to present and analyze the Law on School Violence published on September 17, 2011. Some actions which mark the context where the law is emerged are described, and some of its main contents and articles are highlighted. It is established that within the law coexist two antagonistic paradigms. One paradigm denominated 'Control and sanction' which is based on the concept of national security; a behaviorist conception of education and curriculum which claims social efficiency and aggressive comportment. And another paradigm named 'Democratic school coexistence' based on the concept of human security; a critical concept of education which aims toward social reconstruction and the notion of school coexistence. The consequences of the implementation of each of these paradigms on the Committee of good school co-existence, the internal regulations of the school, and the role of the person responsible for school coexistence are also presented.
